How to Handle Debt Collection Issues in Nevada

We understand how stressful it is when debt collectors start calling or sending letters to the Nevada Legal Advisors. Handling debt collection problems in Nevada can be too much to handle, especially if you don’t know what your rights are or what to do. That’s why I want to show you what has worked for people like you in Las Vegas, Henderson, Summerlin, and other Nevada towns.

Knowing Your Rights and Choices

The first thing to remember if you are facing debt recovery actions is that you have rights under both federal and Nevada law. Collectors can’t bother you or threaten you with things they aren’t allowed to do. If you get a notice or a call, I suggest that you read it carefully and make sure the debt is real. Sometimes debts are sold or given to other agencies, and mistakes happen. We always tell our clients at Nevada Legal Advisor to ask for written proof of any debt before doing anything about it.

Answering Debt Lawsuits

If you get a debt lawsuit, you should not ignore it. If you don’t respond to a lawsuit, you could lose by default. Some of my clients have been quick to respond and were able to settle their debts or even get their cases thrown out when the creditor couldn’t prove the debt. If you’re not sure what to do, it’s important to get legal help right away, especially since Nevada has strict court deadlines.

Consumer protection laws in Nevada keep unfair debt collection practices from happening. You should write down every time you talk to a collector if they use bad language, call too often, or threaten you with jail. When collectors break the rules, we help clients file complaints with both the Nevada Attorney General and the Consumer Financial Protection Bureau.

Questions that are asked a lot

Q: Can I tell collectors to stop calling me?
A: Yes, you can ask them in writing to stop, and the law says that most of them have to do what you ask.

Q: What if the debt isn’t mine?
A: Write a letter saying you don’t owe the money and ask for proof. Before continuing to collect, collectors must show proof.

Q: Should I hire a lawyer for a debt lawsuit?
A: You can represent yourself, but getting legal help can help you protect your rights as a creditor and avoid making expensive mistakes.
